These Terms of Business and Use of cdthub.rs ("Terms") are effective from the date of publication on the website on June 12, 2023.

The use of all images, written content, or available services ("Content") is subject to these terms and conditions ("Terms"). The platform cdthub.rs is a "Service" as described in the Terms. By accepting these Terms and conditions of service or using our Service, you understand that this is a legally binding instrument, and you agree to be bound by these Terms and conditions. Please read these Terms of Use in full. If you do not agree with these Terms of Use, do not access or use our service.

TERMS OF USE OF THE PLATFORM

This website is managed by the CENTER FOR DIGITAL TRANSFORMATION Belgrade, headquartered at Kneza Miloša 12 Street, Belgrade, registered with the Business Registers Agency under registration number: 21368601, VAT No: 110616093.

The owner of the cdthub.rs content retains the right to change and/or supplement these Terms and conditions at any time. Visitors are required to check the Terms and conditions in the appropriate chapters/sections as changes can occur between visits or as a result of updates. The content owner will timely inform Visitors about changes to the Terms of use within the updated Terms.

When visiting the cdthub.rs website, Visitor-users must behave in accordance with these Terms and conditions, acknowledge familiarity with them, and fully agree to the use of the website in accordance with them. The right to use the website is not transferable to other individuals or legal entities. Each Visitor is personally responsible for protecting the confidentiality of all entered data where they exist.

Access and Use of Content

Visitors can use cdthub.rs to view, locate, or otherwise use Content available on cdthub.rs for their mobile, computer, or other supported devices ("Device"). To use cdthub.rs, you will need a Device that meets the system and compatibility requirements for the relevant Content. The availability of Content and features may vary from country to country, and not all content or features may be available in every country or region.

Use of the Contact Form

To access and use the Contact Form features, it is necessary for the Visitor to enter mandatory information.

By creating a contact form query, you agree to:

(1) provide accurate, current, and complete information; (2) not provide the data of other individuals when creating a contact form query, and

(3) the access data is intended exclusively for the authorized user and must be protected by applying adequate measures from unauthorized access by others; if the user notices unauthorized use of the account or discovers or suspects any security breach related to the Service, the user must immediately inform the operator. The user is responsible for the consequences of use by others if the user is responsible for it or fails to prevent it.

Creating a contact form query requires entering mandatory information, such as an email address. Within the query, and when creating the contact form query, the Visitor will be asked to enter additional information, such as name, surname, mobile phone number, and similar. This data is stored within that account and used to enable the provision of the Service to the user in accordance with the laws and regulations of the Republic of Serbia, in accordance with our Privacy Policy.

Unauthorized Account Access

Visitors are required to keep their query data secure. Visitors are not allowed to collect or disclose any personal data of any Visitor-user of cdthub.rs.

Protection from Malicious Software

To protect you from third-party malicious software, URL addresses, and other security issues, cdthub.rs may receive information about the network connections of your Device, potentially harmful URL addresses, and the operating system on your Device.

Damaged Content

When Content becomes available to a Visitor, the Visitor should check whether the Content functions correctly and executes as stated, and notify the operator as soon as possible if any errors or omissions are found. 

Free Content

cdthub.rs may allow Visitors to freely view or use Content on cdthub.rs. Additional restrictions may apply to your access and use of specific free content.

Complaints

If you are not satisfied with any aspect of the cdthub.rs service, you can submit your complaint via the contact form. We are obliged to initiate the processing of your complaint within 5 working days of receiving the message and to resolve it in good faith and within a reasonable time frame of up to 8 working days. We will notify you by email when your agreed procedure begins and when it is completed.

CONTENT AND INTELLECTUAL PROPERTY

Authorization for Content Use

The Visitor has a non-exclusive right, solely as expressly permitted in these Terms and related policies, to access and view the applicable cdthub.rs Content on Devices or otherwise authorized as part of the service solely for personal, non-commercial use. All rights, title, and interest in the cdthub.rs platform and Content not expressly granted to you in the Terms are reserved.

Linking, Reposting, and Any Other Use of Content from the cdthub.rs website must be clearly marked and the cdthub.rs website identified as the source.

Violation of Authorization Terms

If you violate any of the Terms, your rights under this license will immediately cease, and cdthub.rs may terminate your access to cdthub.rs Content.

Limitations

You are not allowed to:

• Display (partially or in full) the Content as part of any public performance or display, even if no fee is charged.

• Sell, rent, lease, redistribute, broadcast, transmit, communicate, modify, sublicense, assign any Content to any third party, including in connection with any download of Content you may obtain through cdthub.rs.

• Use cdthub.rs or any Content in combination with any streaming, stream, or use of recording options or similar software for recording or creating a copy of any Content presented in streaming format.

• Use the Content as part of any service for sharing, lending, or multi-person use, or for any other purpose of any institution.

• Any form of assistance, authorization, or encouragement of others in an attempt to bypass, disable, or destroy any form of security measures or components that protect, obscure, or otherwise limit access to any Content or cdthub.rs.

• Attempt or act of removing watermarks, labels, or other legal or proprietary notices that exist in the Content.

• Attempt or act of modifying or intervening in any Content provided to the User through cdthub.rs, including any modification for the purpose of concealing or changing any indications of ownership or source of the Content.

Removal or Unavailability of Content

In accordance with the Terms, the Content available to Visitors through the Service will be available via cdthub.rs as long as cdthub.rs has the right to make such Content available, and in accordance with the limitations of Content availability clearly indicated on the pages of the Content itself. In certain cases (for example, if cdthub.rs loses relevant rights, services, or if the Content is discontinued, there are critical security issues, or there are violations of applicable terms or laws), cdthub.rs may remove Content from the website or cease to provide access to specific Content.

Unless otherwise indicated, the Service is the property of CENTAR ZA DIGITALNU TRANSFORMACIJU d.o.o. Belgrade or our providers or licensors and is protected by copyright, trademark, and other laws of the Republic of Serbia and foreign countries.

You will not remove, alter, or conceal any copyright, trademark, service or other proprietary notices incorporated in the Services or accompanying them.

cdthub.rs and the CDT HUB  logo, as well as the CDT logo, are trademarks or registered trademarks. cdthub.rs and the marks and the marks of their possible affiliates may not be copied, imitated, or used, in whole or in part, without prior written permission.

All other trademarks, service marks, logos, trade names, and any other proprietary designations are the trademarks or registered trademarks of their respective owners and may not be used without the permission of the respective trademark holder.

LAST ITEMS

Indemnification

You agree to defend, indemnify, and hold harmless cdthub.rs and its affiliates, independent contractors, and service providers, as well as any of our directors, officers, employees, and agents, from and against any third-party claims, damages, costs, liabilities, and expenses (including but not limited to reasonable attorney's fees) arising out of or related to:

• your use or inability to use the Services;

• any breach of these Terms or any other applicable terms, guidelines, warnings, or instructions provided by cdthub.rs or a third party in connection with the Services;

• any violation of any applicable law or the rights of any third party.

The Visitor-user is solely responsible for acquiring, using, and maintaining their own computer equipment, including but not limited to all software and hardware they own and use, as well as other equipment necessary to access and use the cdthub.rs website and the Services associated with it, and all related costs. The cdthub.rs platform is not responsible for any damage to the Visitor's equipment that may result from using these websites.

Limitation of Liability

The cdthub.rs platform will not have any liability for any lost profits or other consequential, special, punitive, indirect, or incidental damages arising out of or related to your use or inability to use the services, even if the cdthub.rs platform has been advised of the possibility of such damages. In no event will the total liability of cdthub.rs arising out of or in connection with the use or inability to use the services exceed the amount you paid for using our services. The foregoing disclaimer of certain damages and limitation of liability will apply to the maximum extent permitted by applicable law.

The laws of some states or jurisdictions may not allow the exclusion or limitation of certain damages, so some or all of the above disclaimers and limitations may not apply to you. Regardless of anything to the contrary in these terms, nothing in these terms excludes or limits our liability for fraud or for death or personal injury caused by our negligence. Each Visitor-user of the cdthub.rs website expressly agrees to use these websites at their own risk. cdthub.rs, nor any of its employees, agents, third-party service providers, or licensed companies, makes no warranties that the use of these websites will not be interrupted, intercepted, or error-free; nor does it warrant (1) the consequences that may arise from using these websites, or (2) the accuracy, reliability, or content of any information, service, or product provided through these websites. In no event will cdthub.rs, or any other physical or legal entities involved in the creation, production, or distribution of these websites, Content, and Services, or related content and/or software, be liable for any damages that may arise from using or inability to use these websites. Applicable Law

The laws of the Republic of Serbia, excluding conflict of laws rules, govern access to and use of the Services. Your access to the Services and their use may also be subject to other local, state, national, or international laws. In order to avoid any doubt about the disclaimer of liability by cdthub.rs, the Visitor-User will not be denied the prescribed rights, nor the rights arising from a contractual relationship with cdthub.rs. Please read the following section carefully as it requires you to submit to binding arbitration (waiver of jury trial) with respect to any and all disputes (except certain intellectual property claims and small claims disputes) with cdthub.rs and limits the way you can seek relief from cdthub.rs (no class arbitrations, class actions, or representative actions or arbitrations). Furthermore, you agree that all disputes, causes of action, claims, or controversies arising out of these Terms that cannot be resolved through informal negotiations will be exclusively resolved in the Republic of Serbia, Belgrade, by the competent courts, and you agree to submit to the personal jurisdiction of such courts for the purpose of litigating all such claims to the extent permitted by law. Courts in some countries may not apply the laws of the Republic of Serbia to certain types of disputes or allow you to consent to the jurisdiction in the Republic of Serbia. If you live in one of those countries, the laws of your country will apply to such disputes related to the Services. If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, then that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions. You may not assign these Terms or any of the rights granted under this Agreement without the prior written consent of cdthub.rs, and any attempt to transfer without such consent will be void. Subject to the foregoing limitation, these Terms will be binding, inure to the benefit of, and be enforceable by us and our respective successors and assigns. Operational Status of the Platform cdthub.rs strives to keep the platform and Content constantly available and functioning without interruption and errors. However, due to technical conditions such as changes in configuration, maintenance, device malfunctions, and the like, we cannot always guarantee this. In case of service interruptions, cdthub.rs will make every effort to restore the functionality of the service as soon as possible. cdthub.rs assumes no responsibility for possible consequences arising from the lack of (complete) functionality.

Operational Status

of the Platform cdthub.rs strives to keep the platform and Content constantly available and functioning without interruption and errors. However, due to technical conditions such as changes in configuration, maintenance, device malfunctions, and the like, we cannot always guarantee this. In case of service interruptions, cdthub.rs will make every effort to restore the functionality of the service as soon as possible. cdthub.rs assumes no responsibility for possible consequences arising from the lack of (complete) functionality.

Changes to these Terms

If the Terms change, you will be notified, and the new Terms will take effect after such notice. Your continued use of cdthub.rs after such notice will mean that you accept the new Terms. The new Terms will apply to your use of the entire Content (including Content you have used in the past) and all subsequent uses. If you do not agree to such changes, you will be given the option to discontinue using cdthub.rs. Centar za digitalnu transformaciju d.o.o. Belgrade reserves the right to manage the cdthub.rs platform with reduced and/or limited functionalities or to discontinue this service in the future.
